The purpose of this project is to deal with the legal affairs of asking responsible enterprises to pay the waste recycle and disposal fees, to resolve legal issues of violating the “The Waste Disposal Act” and other environmental laws and regulations by recycling business enterprises and waste management business enterprises, and to enhance the efficiency of administrative procedure by exercising external legal professional resources to handle associate legal affairs and provide legal training programs which are related to waste recycling laws. The approach of executing this project is to draft legal documents in civil lawsuits and administrative appeal and litigation procedures while responsible enterprises, which are under the authority of the Board of Resource Recycling Management Fund, recycling business enterprises and waste management business enterprises seeking for remedies against EPA, to remove the document of certain cases to the prosecutor when they are related to criminal law, and to provide counsel and legal training programs. The accomplishment during the term of this project includes defending for EPA in 10 cases of administrative appeal proceedings, 7 cases of administrative litigation, providing legal counsel in 4 cases, drafting legal documents in 2 cases of civil lawsuits, and holding 4 times of legal training programs. Reviewing every item executed by our firm in this project, we have achieved the goal of exercising external legal professional resources and enhancing the efficiency of administrative procedures, based on the approach of resolving the immediate legal issues of EPA, adjusting the general acknowledgement of laws, and establishing the correct knowledge of laws.
